About Family Courts in New York City

In New York, the Family Court takes action in legal issues related to the lives of children, parents and spouses. It has a broad range of powers designed to address child abuse and neglect, adoption, child custody, visitation, domestic violence, foster care, guardianship, juvenile delinquency, paternity, Persons in Need of Supervision (PINS), child support and spousal support. There are five Family Courts in New York City, one for each borough, including the Bronx, Brooklyn (Kings), New York (Manhattan), Queens and Richmond (Staten Island). Most cases brought to Family Court may be filed without a fee in the county where you live.

The majority of Family Court hearings, or trials, are heard by judges, though support magistrates (lower court judges) handle support and paternity cases. There are no jury trials in Family Court; the judge or support magistrate will conduct the hearing and will make a determination of the case outcome. After a final decision made by a Family Court judge or support magistrate, either party may have the right to appeal the decision by asking a higher court to review the matter. An appeal may result in a modification or reversal of the original decision, or it may be left as is.
