New York Child Custody Attorneys

Who gets custody of the children can be a very stormy issue. There are very few cases where a couple can agree upon who the children will live with a majority of the time. In many instances, a person who is going through a divorce may be very bitter towards a spouse and retaliate by fighting for all rights to the children. The good news, however, is that a judge will always rule on what they feel is in the best interest of the children. If they see that one spouse is falsifying information in an attempt to win child custody, then that spouse will most likely lose certain custodial rights.

Types of Custody in New York

When awarding child custody, one or both parents can receive legal custody and physical custody. Legal custody allows for parents (joint legal custody) or one parent, to make decisions as to how the child should be raised, including religious, medical and educational choices. Physical custody determines who the child resides with a majority of the time. Both parents may be awarded joint physical custody of a child, if both parents live close by. This would allow for both parents to equally share in all aspects of the child’s life. However, one parent will be legally determined the primary residential parent.  If only one parent is awarded physical custody, the other parent (the non-custodial parent) may be awarded visitation and most likely will be the one required by law to pay child support.

Shared custody may be awarded if both parents can prove that they are able to care for the child equally. Shared custody allows both parents to share in all aspects of the child’s life, and living arrangements will also be equally shared. Shared custody or joint custody of a child would be the best case scenario if possible, because a child deserves equal care and love form both parents. However, if there are any issues, such as a parent who is unfit due to mental, drug or alcohol type issues then sole custody may be awarded and the unfit parent will most likely only be allowed supervised visitation, if any.
