Child support is an amount of money paid by a non-custodial parent to a custodial parent. This generally occurs after a divorce or separation but may arise in a situation where unmarried parents establish paternity. Child support is a legal obligation. Both parents are considered responsible for the welfare of the child, even if only one parent has custody or has primary custody. In New York, child support may be determined in one of two ways: through an out-of-court agreement or as the result of a Family Court verdict. When the court is involved, child support will be based upon a set calculation of both parents' income and the number of children. If parents are able to reach an agreement outside of the courtroom, it may vary from these guidelines but may still be subject to court approval.

In New York, child support is determined by taking the parents' gross income, minus deductions for social security and certain taxes, and multiplying it by the percentage that applies (based upon the number of children):

  • 17% for one child
  • 25% for two children
  • 29% for three children
  • 31% for four children
  • At least 35% for five or more children

The non-custodial parent will be ordered to pay his or her share of this percentage. Child support generally lasts until the child turns 21, although an arrangement may be made where a parent continues to support a child until he or she is done with college.
